Plaintiff alleged his business location burned as a result of improper repair work performed by Angel Heating & Air Conditioning. The basis for the claim was that the fire occurred within weeks of the last repair attempt made on an air conditioner on the building’s roof. Angel Air filed a Motion for Summary Judgment with the Court arguing that Plaintiff had no evidence of the cause and origin of the fire. Angel Air further argued that Plaintiff needed expert witness testimony to establish the cause and origin of the fire and did not designate such a witness. Court ruled in Angel Air’s favor finding no triable issue of fact as to the cause and origin of the fire as Plaintiff failed to identify any document or witness that would provide that the fire started on the roof and/or started as a result of any improper repair work.
