Defense Prevails on Motion for Summary Judgment on a Wrongful Death Case

Plaintiffs, through a nationally known product liability law firm, filed a wrongful death and personal injury lawsuit arising out of a Chevrolet Silverado rollover on southbound I-5 in Ventura County that occurred on July 4, 2007. Plaintiffs alleged a defective tire caused a tread separation that resulted in the rollover. Our firm’s client, California Tire, serviced the subject vehicle in January 2007 (approximately six months prior to the accident date) and Plaintiffs argued California Tire should have removed the allegedly defective tire and/or warned of the allegedly dangerous condition of the tire. Our firm’s Motion for Summary Judgment on behalf of California Tire was granted on April 19, 2010 as the court agreed Plaintiffs could not establish causation.
